Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)A, 26, 35 of the Arms Act.
One country made loaded pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner and admittedly, the present case has been registered only for the offences punishable under the Arms Act. No doubt, one kidnapped person is said to have been recovered from the place of occurrence but admittedly, the aforesaid recovery was made from the house of co-accused, Bindeshwar Choudhary. Moreover, petitioner does not have any
Patna High Court Cr.Misc. No.14701 of 2016 (2) dt.08-04-2016 2/2 criminal antecedent and is languishing in jail custody since 18.09.2015.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 189 of 2015.
