The petitioner seeks bail in connection with Special Case No.4002 of 2021 arising out of Alamganj P. S. Case No.378 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 01.08.2021 and charge-sheet has been submitted in the case.

Allegation is of recovery of 320 litre of liquor from a boat and the petitioner was arrested.

The learned counsel for the petitioner submits that petitioner was completely unaware that which of the passenger

The learned counsel for the petitioner submits that petitioner has no concern with the liquor and he was implicated based on his antecedent as mentioned in Para-3 of the bail application.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 01.08.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No.4002 of 2021 arising out of Alamganj P. S. Case No.378 of 2021.

The application stands allowed.
