The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 23.03.2021, charges have been framed and has antecedent of four cases.
Allegation is of looting the bank of Rs.14,42,170/- by six unknown criminals. Further the criminals even looted some customers also.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He has not been put on T. I. Parade and his name transpired in the
Patna High Court CR. MISC. No.58546 of 2021(2) dt.18-04-2022 2/3 confessional statement of co-accused Pappu Kumar and Jitendra Rajbansh. It is further submitted that during the course of investigation, it is alleged that Rs.20,000/- was recovered from his house. The learned counsel submits that the said amount belonged to the petitioner as there is absolutely no investigation to connect the alleged recovered amount as that of the Axis Bank which was looted i.e. Gramin Bank.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, charges have been framed and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nardiganj P. S. Case No.40 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Jagdish Rajvanshi @ Jagdish Ram. Further the petitioner will appear on day to day basis in the trial. In the event, if the petitioner does not appear on two consecutive dates, the learned Court below shall forthwith cancel his bail bonds.
