JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code and Section 27 of the Arms Act.
It is a case of commission of murder of the informant's son namely Chhote Lal Paswan by two gunshot injuries by unknown criminals.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.51520 of 2023(2) dt.05-09-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and only on the basis of confessional statement of co-accused Atul Pandey, the petitioner has been roped in the present case. The petitioner was not apprehended from the spot nor anything has been recovered from the conscious possession of the petitioner. There is no eye witness to the occurrence. During investigation also, no concrete material evidence was collected against the petitioner to connect him with the present case. The petitioner is languishing in custody since 29.04.2023. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,
