JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 120(B) of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

One country-made pistol and two live cartridges are said to have been recovered from possession of the petitioner when the petitioner and others had assembled to make preparation for committing dacoity.

Contention on behalf of the petitioner is that petitioner does not have any criminal antecedent and the present case is nothing but only high-handedness of the police. It is further submitted that according to prosecution case itself, the alleged

Considering the above-said facts and circumstances of the case as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rasulpur P.S. Case No. 131 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra.
