JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 307, 504 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was also added.
Petitioner is not named in the first information report and informant claims that it was co-accused, Rajesh Kumar who gave dagger blow to deceased. The aforesaid co-accused was arrested and disclosed the name of the petitioner. It appears that except the aforesaid confessional statement of co-accused, there is nothing against the petitioner, who is languishing in jail custody since 28.11.2015.
Patna High Court Cr.Misc. No.14050 of 2016 (2) dt.05-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Thakur, Judicial Magistrate 1st Class, Danapur in connection with Shahpur P.S. Case No. 187 of 2015.
