The petitioner apprehends his arrest in connection with Katihar Town P. S. Case No. 753 of 2017 registered for the offences punishable under Sections 153, 153A, 295, 295A, 384, 307, 506/34 of the Indian Penal Code.

Allegedly, the petitioner along with others were forcing to other shopkeepers to close their shops and further Ranjeet Sah and Chhotu Poddar were seen in CCTV footage opening fire. They also assaulted the Police personnel.

Submission is of false implication and that the petitioner is Ward Councilor, he has been falsely named by the Police personnel. During investigation no shopkeeper came forward to say that the petitioner was indulged in closing the shop. All the

Patna High Court Cr.Misc. No.61127 of 2017(3) dt.23-01-2018 2/2 police personnel have been examined during investigation. The petitioner has been allowed bail in Katihar Town P. S. Case No. 729 of 2017 vide Cr. Misc. No. 58801 of 2017, as a matter of fact the petitioner has tried to pacify the matter and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that no shopkeeper has been examined during investigation and the witnesses examined are Police personnel and the petitioner was not seen in CCTV footage, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P. S. Case No. 753 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
