The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act and Sections 272/273 of the Indian Penal Code. 81 liters of illicit foreign liquor has been recovered from a bush, which was unloaded from a truck and this petitioner was remanded in this case.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal antecedent of similar nature and he is in custody in this case since 16.08.2021. Learned A.P.P. for the State has opposed the bail petition.

No.58431 of 2021(2) dt.17-12-2021 2/2 Considering the fact that petitioner has got one criminal antecedent of similar nature, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bochahan P.S. Case No. 230 of 2020 after framing of the charge.
