The petitioner is languishing in custody since 28.11.2014 in a case registered for the offences punishable under sections 302/201/120B/34 of the Indian Penal Code. It is alleged that the husband of the informant went to a fair in the company of Prem Marandi, Sushil Marandi and Naresh Tuddu, thereafter, the husband of the informant went in the company of co-accused Rohit Hembram, Manoj to the house of this petitioner. On next day, the dead body of the husband of the informant was recovered from a water channel when suspicion was raised against the petitioner and others. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.24217 of 2015 (2) dt.14-07-2015 2/2 that the accusation has been levelled only on suspicion. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the suspicions nature of accusation, co-accused has been granted bail vide Criminal Miscellaneous No. 3200 of 2015 and petitioner having no criminal antecedent, let him be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, 3rd, Purnea in connection with Barhara P.S. Case No.243 of 2013.
