JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Petitioner and two others are said to have assaulted the injured, Zahid Hussain and it is specific that it was co-accused, Qaiyum Khan, who gave lathi blow on the head of injured, Zahid Hussain. Annexure-4 to this petition shows that injured, Zahid Hussain sustained one injury on his head and the aforesaid injury was found grievous in nature but according to prosecution case itself, the author of the aforesaid injury is co-accused, Qaiyum Khan, who has already been granted privilege of bail. Moreover, there is case and counter case between the parties and persons

Patna High Court Cr.Misc. No.14964 of 2016 (2) dt.11-04-2016 2/2 from both the sides sustained injury.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R. Narayan, Judicial Magistrate 1st Class, Araria in connection with Palasi P.S. Case No. 107 of 2015.
