JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is specific allegation of gang rape against the petitioner and it appears from perusal of the impugned order that in her statement recorded under Section 164 of the Cr.P.C. the victim has supported the allegation. Moreover, the medical report of victim also corroborates the allegation.

Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Special (POCSO) Case No. 76 of 2014

Patna High Court Cr.Misc. No.23160 of 2015 (2) dt.14-07-2015 arising out of Digha P.S. Case No. 337 of 2014 pending in the court of learned 1st Additional Sessions Judge, Patna stands rejected.
