JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is languishing in custody since 03.04.2015 in connection with Maniari P.S. Case No. 75 of 2015 for the offences instituted under Sections 420 read with 34 of the I.P.C. and 8 and 9 of the Prevention of Corruption Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant who was working as the officer-in-charge, Maniari P.S. received a call on official mobile of the P.S. bearing No. 9431822357 from a Mobile No. 9973133352 and caller requested to meet with the informant and thereafter one person(the petitioner) came and he handed over an envelop containing Rs. 5000/- and told the informant that it was a small gift sent by one Babloo Kumar

Patna High Court Cr.Misc. No.24957 of 2015 (2) dt.16-07-2015 2/2 Mishra who was the Deputy Project Manager of the Toll Plaza. It is further alleged that the petitioner was arrested with money and seizure list of recovered money was prepared in presence of witnesses and the copy of same was given to the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.04.2015 and the charge sheet has been submitted in the present case. As per allegation, it is submitted that the petitioner had tried to bribe the informant by offering Rs. 5,000/-. It is further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance (North Bihar), Muzaffarpur, in connection with Special Case No. 11/2015, arising out of Maniari P.S. Case No. 75 of 2015.
