The petitioner is languishing in custody since 23.12.2014 in a case registered for the offences punishable under Sections 394, 458, 459 and 411 of the Indian Penal Code. The accusation is of robbing the informant's cash and jewelleries after entering into the room when the FIR was lodged against three FIR named persons. The name of the petitioner sprang up during investigation on confession of the coaccused. Subsequently the petitioner also made confession. At the instance of the confession of the petitioner and other co-accused persons certain robbed articles were recovered from the hutment of Gautam Kumar.

Patna High Court Cr.Misc. No.23499 of 2015 (2) dt.17-07-2015 2/2 It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been apprehended and the recovery was made from other accused persons.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 314 of 2014.
