In the instant petition, petitioner's presumption and assumption is that in identical matter, petitioner was subjected to disciplinary proceedings and it was concluded in exoneration. The disciplinary authority now proposed to initiate once again an eqnuiry on the very same charges, however, copy of the charge memo has not been issued to the petitioner as on this date. Therefore, the present petition is not maintainable. Accordingly, the writ petition stands dismissed as

Patna High Court CWJC No.17389 of 2021(2) dt.02-03-2022 2/2 withdrawn, reserving liberty to file petition as and when identical charges are framed.
