Having regard to the nature of allegation for offence under Section 302 of the Indian Penal Code and that the petitioner's complicity is surfaced, as alleged by the informant/wife of the deceased, as the person last seen in the company of the deceased, her husband, this Court would not be impressed either with the submission of the learned counsel for the petitioner that there was delay in lodging of the FIR or that the informant subsequently had sought to compromise by filing an application.
That being so, the prayer for anticipatory bail of the petitioner is hereby rejected, but then nothing said in this order shall come in the way of the petitioner in surrendering and making prayer for regular bail.
