JUSTICE SHIVAJI PANDEY ORAL ORDER 11-05-2016 It is the second attempt of petitioner for regular bail in connection with Rajoun P.S. Case No.89 of 2015, registered for the offences punishable under Sections 302, 353 of the Indian Penal Code, but charge has been framed under Section 302 of the Indian Penal Code.

Earlier the petitioner has moved before this Court in Criminal Miscellaneous No.49736 of 2015 for regular bail and this Court vide order dated 06.11.2015 rejected the bail application of the petitioner.

In this case, allegation has been made to have crushed the police official while he was discharging the duty in the night.

The status report shows that the case has been

Patna High Court Cr.Misc. No.15657 of 2016 (3) dt.11-05-2016 2/2 committed to the Court of Sessions and charge sheet has been framed.

As in the present case, the charge-sheeted witnesses are by and large the official witnesses this Court is not inclined to grant bail to the petitioner. However, the Trial Court is directed to conclude the trial within a period of nine months from today. The Superintendent of Police, Banka, is directed to ensure the production of all the charge-sheeted witnesses so that the trial may be concluded within the aforesaid period.
