Petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The Sim of the petitioner is said to have been used in stolen mobile but submission on behalf of the petitioner is that the mobile with Sim of the petitioner was lost and petitioner got issued a new Sim of the same number from service provider and the aforesaid Sim has been recovered from possession of the petitioner. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 1.11.2015. Accordingly, the petitioner above named is directed
