JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-12-2017 Learned counsel for the petitioners submits that petitioner no. 1, Raj Kumar Paswan, has been apprehended by the police, so he seeks permission to withdraw this application with regard to him.

Permission is accorded.

Accordingly, this application is dismissed as withdrawn. Heard learned counsel for the petitioner no. 2 and the learned A.P.P. for the State.

The petitioner no. 2 apprehends his arrest in connection with Muzaffarpur Sadar P.S. Case No. 355 of 2017 registered under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the daughter of the

Patna High Court Cr.Misc. No.57789 of 2017 (2) dt.19-12-2017 informant by her husband and in-laws including the petitioners due to non-fulfillment of demand of dowry and also to dispose of her dead body.

Learned counsel for the petitioner no. 2 submits that petitioner no. 2 is the maternal father-in-law of the deceased, daughter of the informant, and he used to reside in his village at Madhopur Susta, P.S. Maniyari, District Muzaffarpur, and only he participated in the negotiation of marriage due to that reason he has falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioner no. 2 be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Sadar P.S. Case No. 355 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
