The petitioner apprehends his arrest in connection with Bihta P.S. Case No. 452 of 2020 registered for the offences under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has tried to convince this Court by producing a copy of the order dated 15.07.2021 passed by a coordinate Bench of this Court in Cr. Misc No. 3048 of 2021 that his case for anticipatory bail was found on similar footing than that of co-accused. Learned APP for the State submits that the aforesaid order was passed in the case of the petitioner against whom there was no specific overt act whereas in the present case, petitioner has ordered to fire.
