Petitioner and six others are named in the first information report with accusation that they administered poison to the deceased but in course of investigation, it came to light that deceased had love affair with one Rani Kumari, who happens to be sister of the petitioner, and when the marriage of aforesaid Rani Kumari was settled with another person, deceased consumed poison. The Investigating Officer after taking note of the aforesaid fact submitted final form showing mistake of facts but the learned court below having differed with the finding of Investigating Officer took cognizance of the offences against the petitioner and
