====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 19-08-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend arrest in connection with G.B. Nagar P.S. Case No. 160 of 2023 dated 07.05.2023, instituted for the offence punishable under Sections 341, 323, 307, 379, 504, 506 & 34 of the Indian Penal Code.
3. The prosecution case, in short, is that on 06.05.2023, when the informant along with his son was going to market on his motorcycle then petitioner no. 1 dashed the informant's bike with his motorcycle. When the informant's son

No.51082 of 2023(2) dt.19-08-2023 2/3 asked him why have you dashed me then petitioner no. 1 has started abusing them and called petitioner nos. 2 & 3 and other named accused persons and they assaulted informant and his son. It is further alleged that they have also snatched cash of Rs. 53,000/- and one gold chain.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. The entire allegations levelled against the petitioners are false and concocted. It is further submitted that petitioner no. 1 assaulted the son of the informant, namely, Dhiraj Kumar Giri on head with sword but from perusal of injury report, it appears that he has received simple injury caused by hard and blunt substance, which falsify the prosecution story. Lastly, it has been submitted that they have one criminal case pending against them.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with G.B. Nagar P.S. Case No. 160 of 2023, they shall be released on anticipatory bail
