Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-07-2019 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Muffasil P. S. Case No. 232 of 2019 instituted for the offence under Section(s) 341,342, 324, 307, 302 and 427/34 of the Indian Penal Code. Learned counsel for petitioner submits that although petitioner is named in the written report but, there is no allegation of any specific overt act against this petitioner. It is further submitted that other accused persons with similar allegation has already been granted bail by this Court by order passed in Cr. Misc. no. 43574 of 2019.

In the written report, it is alleged that on the date of occurrence, informant along with Aman Kumar was going on

Patna High Court CR. MISC. No.44942 of 2019(2) dt.23-07-2019 2/2 motorcycle. Two boys were causing obstruction in traffic near Bharra Chowk. The informant requested to give way upon which one Randhir Kumar assaulted the informant with fists and slaps. In the meantime, Aman Kumar ( since deceased), who was sitting on the motorcycle, made firing in the air. Thereafter, Randhir Kumar his father Vijay Paswan and other family members and 15-20 unknown persons assaulted them by rod and bricks etc. on account of which Aman Kumar died. Petitioner is in custody since 11.5.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Begusarai in connection with Muffasil P. S. Case No. 232 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
