2. This application has been filed for quashing of F.I.R i.e. Dagarua P.S. Case No.46/2024 lodged under Section 467 / 468/471/420/406/419/120(B)/ 34 of I.P.C, on the basis of complaint lodged by Opp.party no.2 and also to stay the operation of F.I.R of Dagarua P.S. Case No.46/2024 which is pending before the learned A.C.J.M 1st, Class, Purnea.

3. The petitioners want quashing of the aforementioned F.I.R.

4. From reading of the F.I.R., it appears that offences are made out against the petitioners and in my opinion, no ground for quashing of F.I.R. is made out.

5. Accordingly, this application is dismissed.

6. The petitioner is permitted to approach the Superintendent of Police, Purnea with his defence and if such an application is filed by the petitioner, the Superintendent of Police, Purnea shall direct the Investigating Officer of the case to examine the defence of the petitioner before the submission of chargesheet/final form.
