JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is neither named in the written report of the informant nor in the statement of victim recorded under Section 164 of the Cr.P.C. It appears that in course of investigation, petitioner was arrested and on the basis of his discloser, the victim girl was recovered from the house of co-accused Manauwar Khan, who claimed that petitioner and one other accused had sold the victim to him.

Learned counsel for the petitioner submits that coaccused Manauwar Khan, from whose house the victim was recovered, has already been granted privilege of bail by this Court. So far as petitioner is concerned, he has no concern either with the

Patna High Court Cr.Misc. No.16228 of 2016 (2) dt.22-04-2016 2/2 victim or the co-accused Manauwar Khan. It is also submitted that the investigation against the petitioner has already been completed and the petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S.Case No. 236 of 2015/G.R.
