JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A, 26, 35 of the Arms Act.
Petitioner and one other accused were caught when they were allegedly assembled to distribute the looted amount. On search, one country made pistol containing three live cartridges, mobile set and a bag containing more than rupees two lacs were recovered from possession of the petitioner and similarly, firearms were recovered from possession of other accused. Learned counsel for the petitioner submits that present case has been lodged for the offences punishable only
Patna High Court Cr.Misc. No.16199 of 2016 (2) dt.22-04-2016 2/2 under the Arms Act and for the recovery of firearms, petitioner is in jail custody since 27.11.2015 whereas other accused has already been granted privilege of bail by this court. It is further submitted that so far as criminal antecedent of the petitioner is concerned, he has been remanded in one Dumra P.S. Case No. 314 of 2015 which had been lodged against unknown and except the present case as well as Dumra P.S. Case No. 314 of 2015, petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S.
