The petitioner is languishing in custody since 19.04.2015 in a case registered for the offences punishable under Sections 341, 323, 307, 324 and 504/34 of the Indian Penal Code. It is alleged against the petitioner that he assaulted with iron rod on the back of the head of the informant. It is submitted by learned counsel for the petitioner that the initial injury report suggests only tenderness on the left side. The doctor has not opined the actual part of the body where the tenderness was found though the final injury report has not been brought on record. Moreover, the investigation has already concluded.

Considering the fact that there is no accusation of repeating the blow and the investigation being concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 174 of 2015.
