JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Muffasil P.S. Case No. 167 of 2019 registered for the offences punishable under Sections 414, 420, 467, 468, 120B, 34 of the Indian Penal Code and Sections 27(A)(B), 28, 28(A) of Drugs and Cosmetics (Amendment) Act, 2008. As per FIR petitioner is said to be running a medicine shop without having proper licence and several medicines were recovered from his shop.

Submission of learned counsel for the petitioner is that there is allegation that medicines are either spurious or expired and petitioner was running the shop under the supervision of Doctor which has come in the FIR and he is ready to abide by any condition that may be imposed on him.

In view of above facts and circumstances, let petitioner surrender in the court below within a period of three weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of above fact and, if possible, to be disposed of on the same day.
