2. The petitioners are apprehending arrest in a case registered for the offences punishable in connection with Udwant Nagar P.S. Case No.433 of 2024 under Sections 126(2), 115(2), 352, 351(2), 76, 117(2) and 3(5) of the BNS, 2023.
3. As per the prosecution, the FIR has been lodged against 7 named accused persons including the petitioners against whom there is allegation that accused persons have entered in the house of the informant and assaulted by hocket stick due to which injury has been caused at the hand and back
Patna High Court CR. MISC. No.50875 of 2025(2) dt.11-08-2025 2/3 of the informant's father. The allegation of snatching golden chain and tried to torn the clothes of female member of the family.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that the petitioners have been falsely implicated in this case. He further submits that both informant and petitioners are agnates and due to domestic problem and house dispute, this false case has been lodged.
5. Counsel also submits that antecedent of the petitioners is clean and they are men of means and no chance of absconding any witnesses. He further submits that there are accused persons whose names inserted in the FIR, are agnates and coparcener.
6. Learned APP for the State opposes the prayer for bail and it is specific pleading taken that parties are agnates and due to domestic problem, scuffling took place between them.
7. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)
Patna High Court CR. MISC. No.50875 of 2025(2) dt.11-08-2025 3/3 each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M., Ara, in connection with Udwant Nagar P.S. Case No.433 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
