JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Bettiah (Town) P.S. Case No. 292 of 2019, disclosing offences under Sections 366(A), 420(B) of IPC and Section 8 of the POSCO Act.
There is allegation against the petitioner is of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the statement of the girl has been recorded under Section 164 of Cr.P.C., in which she has stated that she had gone on her sweet will with one Md. Sartaz, son of the petitioner and nothing has been stated about the petitioner. Further submission is that medical report shows the age of the girl in between 17-19 years.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah (Town) P.S. Case No. 292 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
