Petitioner seeks bail in a case registered under sections 461 and 379 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, petitioner was arrested and one mobile set is said to have been recovered from his conscious possession. The contention on behalf of the petitioner is that the petitioner has been implicated in this case at the behest of his agnate and, as a matter of fact, only one mobile set is said to have been recovered whereas many mobiles sets are said to have been stolen from the shop of informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be

No.15876 of 2016 (2) dt.20-04-2016 released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Tr. No. 377/2016 arising out of Bhagwan Bazar P.S. Case no. 335/2015.
