The petitioner apprehends his arrest in Bodh Gaya P.S. Case No.263 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 25 litres of country made wine is said to have been recovered from the house of the petitioner.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. It is further submitted that there is no compliance of Section 100 Cr.P.C. The petitioner has got no criminal antecedent as stated in para 3 of the bail application.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.
Patna High Court CR. MISC. No.58152 of 2021(2) dt.11-03-2022 2/2 Considering the fact that 25 litres of country made wine has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
