1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Wazirganj Police Station Case No. 39 of 2025, dated 18.01.2025, disclosing offences punishable under Sections 191(2)/191(3)/190/126/115(2)/109/352/351(2) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 18.01.2025, at about 07:30 PM, the petitioners, along with other accused persons, came at the house of the informant, having weapons in their hands, and on the
Patna High Court CR. MISC. No.48809 of 2025(2) dt.11-08-2025 2/3 orders of petitioner no. 1, co-accused Saklain assaulted the son of the informant with garasa on his head, causing head injury.
4. Learned Counsel for the petitioners submits that both the parties are co-villagers and the petitioners have been made accused due to previous dispute. A counter case has been lodged by the side of the petitioners against the informant and others, bearing Wazirganj Police Station Case No. 40 of 2025, and the petitioner no. 1 has also sustained injuries. The specific allegation of assault is upon co-accused Saklain and not against these petitioners. The petitioner no. 1 has been projected in this case as order giver. The petitioners are having no criminal antecedent.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that there is no specific allegation of assault against the petitioners, case and counter case is there between the parties and the petitioners are having no criminal antecedent, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya, in connection with Wazirganj Police Station Case No. 39 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
