====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 22-09-2023 Heard Mr. Gaurav Kumar Verma, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned A.P.P. for the State.

Learned counsel appearing on behalf of petitioner seeks modification in order dated 11.05.2023 passed in Criminal Miscellaneous No. 17384 of 2023 in which the bail bond of the petitioner was not accepted as due to typographical mistake, which has arisen in the prayer portion of the main bail application filed on behalf of the petitioner, wherein a prayer has been made to enlarge the petitioner on anticipatory bail in connection with Belaganj P.S. Case No. 464 of 2020, however, from the perusal of the impugned order as well as the FIR, the correct P.S. Case No. is Belaganj P.S. Case No. 743 of 2022. Relating to the said P.S. case no. the bail application was filed

Patna High Court CR. MISC. No.62600 of 2023(2) dt.22-09-2023 2/2 and as such due to typographical mistake, which has arisen in the prayer portion of the main bail application, which is required to be rectified. Accordingly, the order dated 11.05.2023 also needs to be modified in the interest of justice.

3. Considering the aforesaid submission made on behalf of the petitioner and having perused the FIR, which relates to Belaganj P.S. Case No. 743 of 2022, the reference to Belaganj P.S. Case No. 464 of 2020 seems to be a typographical mistake, which has arisen in paragraph no. 7 of the order dated 11.05.2023 passed in Cr. Miscellaneous No. 17384 of 2023 in view of incorrect reference made in prayer portion of the bail application. The order dated 11.05.2023 passed in Cr. Miscellaneous No. 17384 of 2023 is accordingly modified to the extent that in paragraph no. 7 of the order, in place of Belaganj P.S. Case No. 464 of 2020, the same be read as Belaganj P.S. Case No. 743 of 2022.

4. The other part of the order shall remain intact.

5. Accordingly, the present modification application is disposed of.
