JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-12-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Jamhore P.S. Case No. 93 of 2017 registered for the offence punishable under sections 379, 411 of the Indian Penal Code and sections 3,4,5 of Bihar Illegal Mines Act.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case as they are only the owners of the Tractors in question and they have no concern with the Sand loaded on the tractors. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.54910 of 2017(2) dt.22-12-2017 2/2 petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S. Case No. 93 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
