JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date : 24-07-2018 The grievance of the petitioner is against an order dated 28.07.2017 passed by Secretary, Bihar State Madarsa Education Board, Patna, whereby he has directed the District Education Officer to make on the spot enquiry of Madarsa Gulzaria Warishul Uloom Laucha (Madarsa No. 1190) in the district of Katihar.

Patna High Court CWJC No.1866 of 2018 dt.24-07-2018 2/2 It seems that the enquiry has been ordered as some members of the Managing Committee of Madarsa have resigned and in place of the Chairman and the Secretary, new Chairman and Secretary have been elected and a new Managing Committee has been constituted, as asserted in the writ application. This Court is not required to go into correctness of decision of the respondents to cause an enquiry unless said decision is found to be in breach of any statutory provision. The enquiry has been ordered to find out the facts. I do not feel inclined to acceed to the prayer made on behalf of the petitioner. This writ application is accordingly dismissed.
