The petitioner seeks bail in Uchakagaon P.S. Case No. 195 of 2014, registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The petitioner is not named in the FIR. The petitioner was arrested in Jamo Bazar P.S. Case no. 84 of 2014 under Section 399, 402, 414 of the Indian Penal Code and 3⁄4 Explosive Substance Act. It is alleged that one motorcycle was recovered from the possession of the petitioner.

It is submitted that the petitioner is not named in the FIR and the looted motorcycle was not recovered from the possession of the petitioner. The petitioner is in jail since 23.12.2014. He has

Patna High Court Cr.Misc. No.23723 of 2015 (2) dt.14-07-2015 2/2 already remained in jail for about seven months. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 195 of 2014.
