The petitioner seeks regular bail in a case under section 366-A of the Indian Penal Code.
The informant alleged that the petitioner kidnapped his minor daughter. The victim was recovered and she made her statement under section 164 of the Code of Criminal Procedure, 1973. The victim disclosed that she was enticed by the petitioner and the petitioner took her to Delhi, kept her there for six months. She also alleged that the petitioner established physical relation with her.
It is submitted that the victim was major and she went along with the petitioner out of her own free will. She did not raise any alarm or hue and cry while she was going with the
Patna High Court Cr.Misc. No.7365 of 2015 (3) dt.14-05-2015 petitioner to Delhi. The petitioner is in jail since 18.02.2014 i.e. he has already remained in jail for one year and three months. Considering the facts aforesaid, the above named petitioner Raj Kumar Sah is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Ad-hoc Additional Sessions Judge IV, Araria in connection with Sessions Trial No. 807 of 2014 arising out of Forbesganj P.S. Case no. 350 of 2013.
