JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but no specific overt act appears to have been attributed against them. Moreover, submission on behalf of the petitioners is that having similar allegation, co-accused Bhulan Paswan @ Jhulan Paswan and nine others have already been granted privilege of bail by a co-ordinate Bench of this Court. It is also pointed out that there is case and counter case and in the counter case, the members of the prosecution party of the present case are said to be aggressor.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc.
