JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366, 420/34 of the Indian Penal Code.

The accusation against the petitioner is that he gave Rs. 60,000/- to the father of the informant posing himself as Muslim and gave proposal to informant for marriage but subsequently, informant learnt that petitioner belongs to Hindu community. The informant has supported the aforesaid fact in her statement recorded under Section 164 of the Cr.P.C. It would appear that except the aforesaid allegation, there is nothing against

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 25 of 2016.
