The petitioners apprehend their arrest in a case registered for the offence punishable u/s 147, 148, 149, 341, 323, 307 and 379 of the Indian Penal Code.

As per the prosecution case, allegation against these petitioners is that they along with other accused persons assaulted the son of the informant, namely Mukesh Pawan, with lathi, danda and iron rod and also committed theft of cash of Rs. 15,000/- and gold chain.

It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no offence. They have been falsely implicated in this

Patna High Court CR. MISC. No.52570 of 2024(2) dt.31-08-2024 2/2 case due to grudge. The allegation leveled against the petitioners is not specific rather general and omnibus in nature. It is further submitted that specific accusation of taking away cash and gold chain is against co-accused Manish Ram. It is further submitted that the similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 27.08.2024 passed in Cr. Misc. No. 48871 of 2024. Petitioners have no criminal antecedent.

Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with L.N.M.U. P.S. Case No. 97 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Guddu/- U T
