2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 191(2), 190, 126(2), 115(2), 109, 352, 351(2) of the B.N.S.
3. The case of the prosecution is that the petitioner along with four accused persons being armed with lathi, danda and sharp cutting weapon started assaulting the son of the informant. It is further alleged that due to those injuries, the victim died.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that there is also a counter version of this case. It has also been submitted that both

From perusal of the injury report, it is clear that the deceased has received three ante-mortem injuries. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus. There is no specific allegation as to who has assaulted with which weapon to the deceased. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 06.01.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaurichak P.S. Case No. 726 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 2nd, City Court, Patna.
