1. Heard learned counsel for the petitioner and learned APP for the State.
2. A prayer for bail has been made on behalf of the petitioner in connection with Naubatpur P.S. Case no.133 of 2025 registered under section 309(4) of the B.N.S, 2023.
3. The allegation in the F.I.R is that three bike born miscreants stopped the motorcycle of the informant and threatened him with arms as also snatched his purse, a bag containing Rs.66, 260/- and fled away.
4. Learned counsel for the petitioner submits that F.I.R was lodged against unknown and the name of the
Patna High Court CR. MISC. No.48358 of 2025(5) dt.28-11-2025 2/3 petitioner has transpired in the case on the basis of his identification in the CCTV footage while he was seen chasing the informant along with other co-accused. It is further submitted that Rs.15,000/- as also a mobile phone which was recovered from his possession actually belongs to him. Further, no independent witness has supported the case of the prosecution and while petitioner is in custody since 10.03.2025 no T.I parade has been held. It is further submitted that one of the co-accused has already been granted regular bail by a coordinate Bench of this Court vide order dated 13.08.2025 passed in Cr. Misc. No. 39610 of 2025. The petitioner undertakes to cooperate in the case/trial and charge-sheet has been submitted in the case.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the above mentioned facts of the case and also considering the fact that petitioner has remained in custody since 10.03.2025 coupled with the fact that charge-sheet has been submitted in the case and co-accused has been granted bail by the aforesaid order dated 13.08.2025, the petitioner is directed to be enlarged on bail in connection with Naubatpur P.S. Case no.133 of 2025 on furnishing bail bond of
Patna High Court CR. MISC. No.48358 of 2025(5) dt.28-11-2025 3/3 Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/Successor Court, subject to the following conditions:- (I) One of the bailors of the petitioner shall be the family member/close relative of the petitioner. (II) The petitioner shall remain physically present in Court on each date of the trial and in case he is absent on two consecutive dates without substantial reason, the learned Court is at liberty to cancel the bail bonds of the petitioner.
