JUSTICE SUDHIR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 467, 468 and 406 of the Indian Penal Code. Allegation against the petitioner is that on the assurance of being owner of a Finance Company, he asked the father of the informant to deposit money and, as such, father of the informant deposited money. Thereafter, petitioner cheated father of the informant.
It has been submitted on behalf of the petitioner that petitioner is in custody since 13.1.2016. Chargesheet has been submitted in the case. Petitioner has been made accused due to mistake of fact. As per prosecution case, petitioner is one of the Directors of the said Finance Company but the said allegation is controverted by learned counsel for the petitioner. As per prosecution case also, a cheque of Rs.2.20.000/- was issued in favour of the father of the informant by the Finance Company. Petitioner is ready to deposit an amount of Rs.1,10,000/- in the court below which may be released in favour of the father of the informant.
On behalf of the State and the informant, it is submitted
Patna High Court Cr.Misc. No.16479 of 2016 (3) dt.25-05-2016 2/2 that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit an amount of Rs.1,10,000/- in the court below which shall be released in favour of the father of the informant.
Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Barh, District-Patna, in connection with Badh P.S. Case no. 481 of 2015.
