2. The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 139 of 2022, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
3. As per allegation, the informant had gone to Motihari for the treatment of his sick uncle and when he returned he saw the lock of his door was broken and several things and ornaments were missing.
4. Learned counsel for the petitioner has submitted that he is not arrested at the spot. Nothing was recovered from his possession and his name has figured in the confessional
Patna High Court CR. MISC. No.49332 of 2023(2) dt.25-08-2023 2/2 statement of co-accused Jahir Anari. Except confessional statement, there is nothing against the petitioner in the entire case diary.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 139 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
