The petitioner is languishing in custody since 25.01.2014 in a case registered for the offences punishable under sections 380/120B of the Indian Penal Code.
It is alleged that the petitioner committed theft of Rs.25,000/- cash and jewellary from the house of the informant. It is submitted by learned counsel for the petitioner that petitioner happens to be brother-in-law (sadhu) of the informant and since the wife of the informant took loan of Rs.1,50,000/- from the wife of the petitioner, hence, in order to misappropriate the loan amount the present case has been lodged. There is no recovery from the petitioner. Moreover, the
Patna High Court Cr.Misc. No.24194 of 2015 (2) dt.14-07-2015 2/2 investigation has already concluded.
Considering the nature of accusation and the period in custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Mahnar P.S. Case No.12 of 2014.
