Petitioner is an accused in connection with Chausa PS Case No. 157/2020 registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. He has renewed his prayer for bail inasmuch as earlier bail application of the petitioner was dismissed as withdrawn vide order dated 07.01.2022 passed in Cr. Misc. No. 38072/2021 with an observation that the petitioner may renew his prayer for bail after five months.

As per FIR, one country made pistol and six live cartridges have allegedly been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 17.07.2020 and the charges have

In view of the fact that petitioner is in custody since 17.07.2020, the charges have been framed and this is the second attempt for bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa PS Case No. 157/2020, subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
