JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Ayar P.S. Case No.42 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act. Keeping in view the fact that the petitioner is alleged to be running a mini gun factory, I had rejected his bail application on 17th October, 2014 in Cr. Misc. No.37710 of 2014 and directed the court below to expedite the trial and conclude the same as early as possible.

The petitioner has renewed his prayer for bail mainly on the ground that though the aforementioned order dated 17.10.2014 passed by this Court was received on 31.10.2014 in the court

Patna High Court Cr.Misc. No.23834 of 2015 (2) dt.21-05-2015 2/2 below but till date charges have not been framed. Learned counsel for the petitioner has contended that the petitioner is in custody for over one year and there is no likelihood of conclusion of trial in near future.

Be that as it may, regard being had to the nature of allegation, I am not inclined to grant bail to the petitioner for the present. However, if the trial is not concluded within six months from today, the petitioner would be at liberty to renew his prayer for bail.
