Mr.Ashok Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

The present case was registered on the basis of written report of informant with allegation that on 28.10.2017 he received information from the SHO, Motipur, that dead bodies of two unknown girls have been seen in Litichi orchard of one Krishna Mohan Prasad. It is further alleged that informant came to know that dead bodies of two girls, namely, Gunja Kumari, D/o Jailal Paswan, and Gudia Kumari, D/o of this petitioner were found by their family members and they without ascertaining whether both were murdered or committed suicide

Patna High Court CR. MISC. No.58445 of 2021(3) dt.25-03-2022 2/2 and also without intimating the local police, with the help of family members, hurriedly cremated the dead bodies. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is father of Gudia Kumari and there is no allegation that petitioner conspired or played role in commission of offence. Only allegation against this petitioner is that without giving any information to the local police the dead body was cremated. Petitioner claims clean antecedent and is in custody since 19.06.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, West, Muzaffarpur in connection with Motipur PS case No.394/2017.
