JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case i.e. Araria P.S. Case No. 631 of 2015 was registered against unknown for the offence punishable under Section-379 of the Indian Penal Code, in respect of theft of a mobile phone of the informant and it is stated that the aforesaid mobile phone was recovered from conscious possession of the petitioner in course of investigation. The petitioner is languishing in jail custody since 31-01-2016 and the contention on behalf of petitioner is that nothing has been recovered from his conscious possession.

Considering period of detention of the petitioner in jail custody as well as facts and circumstances of the case, let the
