Petitioners are apprehending their arrest in connection with Mahila P.S.Case no.15 of 2019 , registered for offences punishable under Sections 376 of the Indian Penal Code and Section 4 of the POCSO Act.

Allegation as per the written report is of commission of rape by one co-accused Kailash Ram with the minor daughter of the informant and when she tried to approach to the police station, she was threatened by Kailash Ram as well as the petitioners and other accused persons.

No.47316 of 2019(2) dt.30-07-2019 2/2 Submission of the learned counsel for the petitioners is that they have falsely been implicated int his case and they are not even family members of Kailash Ram rather they are next door neighbour of Kailash Ram and ready to abide by any condition imposed upon them.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st. Addl. District & Sessions Judge, Samastipur in connection with Mahila P.S.Case no.15/2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
